originally sponsored by Sen. Edward Kennedy and Sen. Nancy Kassebaum
Breakdown – Title I : Breakdown – Title I protects health insurance coverage
regulates the availability and breadth of group health plans and certain individual health insurance policies
limits restrictions that a group health plan can place on benefits for preexisting conditions
Breakdown – Title 2 : Breakdown – Title 2 the ASCA mandates rules in three areas, Privacy, Security and the Electronic Data Interchange.
meant to improve the efficiency and effectiveness of the nation's health care system
Privacy Rule : Privacy Rule took effect on April 14, 2003
HIPAA Privacy Rule regulates the use and disclosure of certain information held by "covered entities"
establishes regulations for the use and disclosure of PHI
gives individuals the right to request that a covered entity correct any inaccurate PHI
requires covered entities to take reasonable steps to ensure the confidentiality of communications with individuals
Security Rule : Security Rule took effect on April 21, 2003
complements the Privacy Rule
deals specifically with Electronic Protected Health Information (EPHI)
Administrative Safeguards - policies and procedures designed to clearly show how the entity will comply with the act
Physical Safeguards -controlling physical access to protect against inappropriate access to protected data
Technical Safeguards - controlling access to computer systems and enabling covered entities to protect communications containing PHI transmitted electronically over open networks from being intercepted by anyone other than the intended recipient
Modifications & Finalizations : Modifications & Finalizations December 2000 – introduction of the Privacy Rule
August 14, 2002, the DHHS issued the final modifications to the HIPAA
October 16, 2003 – security rules finalized; Electronic Data Interchange Rule went into effect
